I should have double checked the save rule; we did it right way during the play test (10 or more, not more than 10).
The thing with the blackblade was a bit more complicated than what I wrote. If memory serves, the blackblade had been marked by the Haagalaz using the fighter's "combat challenge" ability. The goblin closed to melee range with the fighter (move action) then shifted into flanking position (minor action, using his "sneaky" ability) so that he could then get his bonus d6 damage from his "combat advantage" ability.
Because the blackblade was marked by the combat challenge, that shift triggered a basic melee attack from Haagalaz.
As for hassling players ... I blame 1st edition. :)
